不動産登記の国籍義務化

政府は、外国人による不動産取得の実態を把握するため、不動産移転登記時に国籍の届出を義務化することにした。

今回の改正には、以下の2つの重要な目的がある：

• 外国人による不動産保有の実態把握: 国土の適切な利用及び管理の観点から、外国人による不動産保有の実態を正確に把握するため
• 相続登記の適正化・円滑化: 不動産の所有権の登記名義人が死亡した場合に適用される準拠法は、その者の国籍によって定まることから、国籍情報を把握することで相続登記をより適正かつ円滑に実施するため

提出された国籍情報は、「検索用情報管理ファイル」という登記所内部のシステムに保有される。第三者が閲覧可能な「登記事項証明書(登記簿)」には記載されないので、プライバシーは保護される。

日本人・外国人を問わず、不動産取引の適正化と投機抑制が図られる方向。

国籍記入義務化は、外国人投資家を排除するものではなく、取引の実態を透明化し、公正な市場環境を整備するための措置である。手続きは煩雑になるが、適切な情報提供とサポート体制の構築が、スムーズな取引の鍵となる。 

Mandatory Nationality Disclosure for Real Estate Registration

The government has decided to mandate the disclosure of nationality during real estate transfer registration to accurately grasp the actual state of real estate acquisition by foreigners.

This amendment has two key objectives:

* Grasping the Actual State of Foreign Real Estate Ownership: To accurately understand the actual state of real estate ownership by foreigners from the perspective of appropriate land use and management.

* * Streamlining and improving inheritance registration: The governing law for inheritance registration when the registered owner dies is determined by that person's nationality. Obtaining nationality information enables more accurate and efficient inheritance registration.

The submitted nationality information will be stored in an internal registry system called the “Search Information Management File.” It will not be recorded on the “Certificate of Registered Matters (Register)” accessible to third parties, thus protecting privacy.

This approach aims to ensure proper real estate transactions and curb speculation, regardless of whether the parties are Japanese or foreign nationals.

The mandatory nationality disclosure requirement is not intended to exclude foreign investors. It is a measure to enhance transparency regarding transaction realities and foster a fair market environment. While the procedures may become more complex, providing appropriate information and establishing a robust support system will be key to ensuring smooth transactions. 

不动产登记国籍申报义务化

为掌握外国人不动产取得的实际情况，政府决定在不动产转移登记时强制要求申报国籍。

本次修订具有以下两大重要目的：

* 掌握外国人不动产持有实态：从国土合理利用与管理的角度出发，准确掌握外国人持有不动产的实际情况

* 规范继承登记流程：因不动产所有权登记名义人死亡时适用的准据法取决于其国籍，掌握国籍信息可促进继承登记更规范、顺畅地实施

提交的国籍信息将存储于登记所内部系统“检索用信息管理文件”中。该信息不会载入第三方可查阅的“登记事项证明书（登记簿）”，隐私权得到保障。

无论日本人或外国人，此举旨在规范不动产交易并抑制投机行为。

强制登记国籍并非排斥外国投资者，而是为提升交易透明度、构建公平市场环境所采取的措施。尽管手续可能繁琐，但完善的信息提供与支持体系将是保障交易顺畅的关键。
