外国人の永住許可について「厚生年金30年水準」を入管庁が厳格化案提示要求

外国人の永住許可の要件を定めたガイドラインについて、出入国在留管理庁がまとめた改定案が判明した。

　入管難民法は、永住許可の要件を（1）素行が善良（2）独立の生計を営める（3）日本国の利益に合う――と規定。入管庁はガイドラインで詳細を定めており、今回の改定で（2）と（3）を厳しくする。出入国在留管理庁によると、昨年末時点で、永住者は約94万7千人。

　日本人世帯の平均を上回る年収に加え、年金の受給見込み額がこの年収水準で厚生年金に30年加入していた場合に受給できる額に達していることを原則求めるなど厳格化する。不足する場合は、補充できる預貯金などがあれば、（2）を満たすと評価する。（3）については新たな基準も設け「自立した言語使用者」とされる日本語能力や、日本の制度・ルールについての理解度も考慮する。

　10月1日付で改定し、来年4月の申請分から適用する方針だが、収入の水準については今年4月以降の申請にも適用するという。

Immigration Agency Proposed to Tighten “30-Year Standard for Employees’ Pension Insurance” for Foreigners’ Permanent Residence Permits

　Details have emerged regarding a draft revision compiled by the Immigration Services Agency concerning the guidelines that set forth the requirements for permanent residence permits for foreign nationals.

　The Immigration Control and Refugee Recognition Act stipulates the requirements for a permanent residence permit as: (1) good conduct, (2) the ability to support oneself independently, and (3) being in the interests of Japan. The Immigration Bureau sets out the details in its guidelines, and this revision will tighten criteria (2) and (3). According to the Immigration Bureau, as of the end of last year, there were approximately 947,000 permanent residents.

　The criteria will be tightened to require, in principle, not only an annual income exceeding the average for Japanese households but also that the projected pension benefit amount reach the level that would be received if the applicant had been enrolled in the Employees’ Pension Insurance for 30 years at that income level. If the income falls short, the requirement under (2) will be deemed satisfied if the applicant has sufficient savings or other assets to make up the difference. Regarding (3), new criteria have been established that will also take into account Japanese language proficiency sufficient to be considered an “independent language user,” as well as the applicant’s understanding of Japanese systems and rules.

The revisions will take effect on October 1 and will apply to applications submitted starting next April; however, the new income standards will also apply to applications submitted from April of this year onward.

关于外国人永久居留许可，“厚生年金30年标准”入管厅提出严格化方案

　关于规定外国人永久居留许可条件的指导方针，出入境在留管理厅拟定的修订案已曝光。

　《出入境及难民法》规定，永久居留许可的条件为：（1）品行良好；（2）能够独立维持生计；（3）符合日本国家利益。入管厅在指南中对具体细节作了规定，此次修订将收紧（2）和（3）两项要求。据出入国在留管理厅统计，截至去年年底，永住者人数约为94.7万人。

　除要求年收入需高于日本普通家庭平均水平外，原则上还要求预计可领取的养老金金额需达到以该年收入水平在厚生年金中参保30年后可领取的金额，以此进一步收紧标准。若收入不足，只要拥有可补充的存款等，即被视为满足（2）项要求。关于（3）项，还将设立新标准，将“能够独立使用语言”所需的日语能力以及对日本制度和规则的理解程度也纳入考量。

　该修订将于10月1日生效，计划从明年4月起的申请开始适用，但关于收入水平的规定将适用于今年4月以后的申请。
