不法就労助長罪について

 不法就労助長罪は2024年6月に改正された入管法によって大幅に厳格化された。施行は2027年4月を予定している。変更点は、3年以下の懲役もしくは300万円以下の罰金から5年以下の懲役もしくは500万円以下の罰金に変更になる。現行は不法就労助長罪でも執行猶予付きのものが多いが、5年以下の懲役になると執行猶予がつかず、実刑になるケースが増えることが想定される。従って非常に重い改正が行われたことになる。

 入管の統計では、2026年1月時点で約74,000人の不法残留者がいる。日本は人手不足が起きているため、外国人の受け入れを増やそうとしている。特定技能2号の受け入れ分野の拡大や、技能実習から育成就労の法整備をしている。外国人が増えれば問題も増えていく。政府は問題を起こした外国人本人に対しては早期に帰国してもらう、つまり強制退去もしくは出国命令をすることなる。また受け入れ企業に対しては問題が発生しないようにきちんと管理することを求めている。

不法就労は次の3つに分けられる。

  1. 在留資格のない者の就労(不法残留、密入国、退去強制対象者)
  2. 入管の許可を受けない就労(短期滞在、無許可の留学生/家族滞在)
  3. 認められた範囲を超える就労(週28時間を超える就労、技人国の業務範囲外、特定技能の分解違反)

 不法就労助長罪とは、不法就労をさせたり、不法就労を斡旋したものに成立する。処罰の対象は会社の代表者だけでなく、実際に採用面接を行った人事担当者あるいは現場で直接指揮命令をしている工場長や店長などの現場責任者も逮捕処罰の対象になる。また過失でも罪に問われることになる。

 企業が確認すべき4つのポイントは、以下の通り。

  1. 在留カードの現物を確認する。
  2. 表面の記載事項を確認する。
  3. 就労不可または一部制限がある場合、必ず裏面の資格外活動許可欄を確認する。
  4. 在留管理長が提供する在留カード等読み取りアプリを用いて偽造の有無をチェックする。

在職中の管理としては、次の3つを行うべきである。

  1. 全外国人従業員の在留期限を一括管理する。
  2. 業務内容の整合性をチェックする。
  3. 留学生が週28時間の制限を超えないように管理する。複数のアルバイトを掛け持ちしている場合には合計で28時間以内にしなければならない。

Regarding the Offense of Facilitating Illegal Employment

The offense of facilitating illegal employment was significantly tightened by the Immigration Control Act, which was amended in June 2024. The amendments are scheduled to take effect in April 2027. The key change is that the penalty will be increased from imprisonment for up to three years or a fine of up to 3 million yen to imprisonment for up to five years or a fine of up to 5 million yen. Under the current law, many convictions for aiding and abetting illegal employment result in suspended sentences; however, with the penalty increased to up to five years’ imprisonment, it is anticipated that suspended sentences will no longer be granted, leading to an increase in cases where actual prison terms are imposed. Consequently, this represents a very significant tightening of the law.

 According to Immigration Bureau statistics, as of January 2026, there were approximately 74,000 overstayers. Due to labor shortages, Japan is seeking to increase the acceptance of foreign workers. The government is expanding the fields eligible for the Specific Skilled Worker (Category 2) program and is establishing legal frameworks to transition workers from technical intern training to post-training employment. As the number of foreign nationals increases, so will the associated problems. The government will require foreign nationals who cause problems to return to their home countries at an early stage, meaning they will be subject to deportation or departure orders. Additionally, the government is requiring host companies to properly manage their employees to prevent such problems from occurring.

Illegal employment can be divided into the following three categories:

1. Employment by individuals without valid residency status (overstayers, illegal entrants, and those subject to deportation)

2. Employment without immigration permission (short-term visitors, unlicensed international students, and family stay visa holders)

3. Work exceeding authorized limits (working more than 28 hours per week, work outside the scope of the Technical Intern Training Program, or violations of the breakdown of duties under the Specified Skilled Worker program)

The crime of aiding and abetting illegal employment applies to those who cause others to work illegally or act as intermediaries for such work. Punishment applies not only to company representatives but also to HR personnel who conducted the actual job interviews, as well as on-site managers such as factory managers or store managers who directly supervise and issue orders. Furthermore, individuals can be charged even if the violation was committed through negligence.

The four key points companies must verify are as follows:

1. Verify the physical Residence Card.

2. Verify the information printed on the front.

3. If the employee is ineligible for employment or subject to partial restrictions, always check the “Permission for Activities Outside the Scope of Status of Residence” section on the back.

4. Use the Residence Card reading app provided by the Director-General of Immigration Services to check for forgeries.

For ongoing management, the following three measures should be implemented:

1. Centralize the management of the residence periods for all foreign employees.

2. Verify the consistency of job descriptions.

3. Ensure that international students do not exceed the 28-hour weekly limit. If an employee holds multiple part-time jobs, the total hours must not exceed 28 hours per week.

关于助长非法就业罪

 根据2024年6月修订的《入境管理法》,助长非法就业罪的处罚规定已大幅收紧。该修订预计将于2027年4月施行。主要变更点在于,刑罚将从“3年以下有期徒刑或300万日元以下罚金”调整为“5年以下有期徒刑或500万日元以下罚金”。虽然现行法律中助长非法就业罪大多可判处缓刑,但若刑期变为5年以下有期徒刑,预计将不再适用缓刑,实际服刑的案例将增加。因此,此次修订可谓力度极大。

 根据入管局的统计,截至2026年1月,约有74,000名非法滞留者。由于日本正面临劳动力短缺,因此正试图增加接纳外国人的数量。政府正在扩大“特定技能2号”的接纳领域,并完善从技能实习到培养就业的相关法律制度。随着外国人的增加,相关问题也会随之增多。对于引发问题的外国人本人,政府将要求其尽早回国,即实施强制遣返或下达出境命令。此外,政府还要求接纳企业进行严格管理,以防止问题发生。

非法就业可分为以下三类:

1. 无居留资格者的就业(非法滞留、偷渡、强制遣返对象)

2. 未获入管许可的就业(短期停留、无许可的留学生/家属停留)

3. 超出许可范围的就业(每周工作超过28小时、超出“技术/人类/国际”签证业务范围、违反“特定技能”分类规定)

 “助长非法就业罪”是指促使他人从事非法就业或为非法就业进行中介的行为。处罚对象不仅包括公司代表,实际进行招聘面试的人事负责人,以及在现场直接下达指挥命令的厂长、店长等现场负责人,也都可能被逮捕并受到处罚。此外,即使是过失行为也会被追究刑事责任。

 企业应确认的4个要点如下:

1. 确认在留卡的实物。

2. 确认卡面记载事项。

3. 若存在禁止工作或部分限制的情况,务必确认卡背面的“资格外活动许可”栏。

4. 使用在留管理局提供的在留卡等读取应用程序检查是否存在伪造。

在职期间的管理应做到以下三点:

1. 对所有外国员工的在留期限进行统一管理。

2. 检查业务内容的合理性。

3. 管理留学生,确保其每周工作时间不超过28小时。若同时从事多份兼职工作,总工作时间必须控制在28小时以内。
