企業の外国人転勤者、来日前の勤務証明必要に 政府の在留審査厳正に
政府は民間企業の外国人職員が日本に転勤する際の在留資格の審査を厳正にする。来日前に勤めていた事業所や本人の勤務の実態に関する資料の提出を求め、調べる。高市早苗政権は在留外国人の適切な管理をめざし資格審査全般を厳しくしている。
外国人が中長期で日本に滞在する場合、目的に応じて在留資格を取る必要がある。出入国在留管理庁は4月から在留資格の一つ「企業内転勤」の運用の見直しを始めた。国内外の企業の外国人職員が主な対象になる。申請者に見直しを通知した。
新たに①外国での社会保険加入の証明②外国の事業所の法人登記や納税状況③日本での事業所の登記簿や写真――といった資料を出すよう義務付ける。従来は資格の審査時に在留証明書やパスポートなどの提出と審査で済んだ。
税の申告のチェックも厳しくする。外国人の職員によっては日本国外から給与が支払われていると主張して、必要な税の申告を怠る例があった。今後は不適切な手続きが判明した場合、原則として資格の更新を認めないようにする。
在留の期間の審査を厳正にする。3カ月、1年、3年、5年がある。最長の5年を超える場合、必要性があるかどうかを出入国在留管理庁が慎重に判断する。期間を定めて在留を認める転勤者向けの資格である点を踏まえる。
高市政権は外国人政策として在留資格の基準見直しに着手している。1月に「永住者」の資格を取る際に日本語能力を求める要件を新設すると決めた。2025年10月には外国人経営者向けの在留資格「経営・管理」の要件として資本金を6倍に引き上げた。企業内転勤は学歴の要件がないなど他の資格に比べて取得のハードルが低いとの指摘があった。審査を厳しくすることで来日前に勤務の実態のない人が駐在員として在留することがないようにする。
企業内転勤の資格で在留する外国人は25年末でおよそ2万人いる。転勤で日本に来る人の中には他の資格より厳しい条件を設けている高度専門職などで在留する例もある。政府は高度人材を含め厳しい審査を経た外国人は積極的に受け入れる方針だ。
企業内転勤は海外で勤務する外国人が転勤で日本の支店で働く際などに使う在留資格だ。ホワイトカラーの経理や企画といった仕事に就くことを想定する。
これと似た資格に専門人材を対象にした「技術・人文知識・国際業務(技人国)」がある。足元で47万人を超え、在留資格のなかで「永住者」に次ぎ2番目に多い。
政府が比較的簡易とされる企業内転勤の審査を厳しくするのは不正の温床になるのを未然に防ぐ狙いがある。企業が勤務実態の伴わない転勤で外国人を入国させたり、単純労働に従事させたりする例を念頭に置く。
技人国では本来認めていない製造業などの職種に従事させる例が少なくないとの指摘もある。25年に在留資格「経営・管理」の資本金の要件を引き上げたのは実態のないペーパーカンパニーで在留するケースが散見されたからだ。
在留資格を全般的に厳しくし、不正の芽を摘む。同時に専門・技術的な分野の外国人材を積極的に受け入れる方針だ。学歴や年収などで高い水準の要件を満たす研究者らが得る資格「高度専門職」は3万人程度で在留外国人全体の1%に満たない。
医薬業界の関係者は企業内転勤の審査が厳正になることについて「影響は小さいのではないか」と話す。「世界中に事業所があるグローバル企業なら、米欧などより厳しい国への在留に必要な手続きは経験済みだ」と語った。
審査を厳しくすることは手続きが煩雑になることを意味する。外国の企業や労働者が日本に進出するインセンティブが薄まるリスクにも配慮する必要がある。
Foreign Corporate Transferees Required to Provide Proof of Employment Before Arriving in Japan; Government Tightens Residency Screening
The government will tighten the screening process for residency status for foreign employees of private companies who are transferred to Japan. It will require the submission of documents regarding the workplace where the individual was employed prior to arrival and the actual details of their employment, and will conduct investigations. The Takaichi Sanae administration is tightening residency status screening across the board with the aim of ensuring proper management of foreign residents.
Foreign nationals staying in Japan for the medium to long term must obtain a residence status appropriate to their purpose. Starting in April, the Immigration Services Agency began revising the implementation of the “Intra-company Transferee” residence status. This primarily targets foreign employees of companies both in Japan and abroad. Applicants have been notified of the changes.
New requirements mandate the submission of documents such as: (1) proof of social insurance enrollment in the foreign country; (2) corporate registration and tax payment records for the foreign business office; and (3) registration records and photographs of the business office in Japan. Previously, the screening process was completed solely through the submission and review of documents such as residence certificates and passports.
Tax filing checks will also be tightened. There have been cases where foreign employees claimed their salaries were paid from outside Japan and failed to file the necessary tax returns. Going forward, if improper procedures are discovered, status renewal will generally not be granted.
Reviews of the duration of stay will be conducted more strictly. Residence periods are currently set at 3 months, 1 year, 3 years, or 5 years. For periods exceeding the maximum of 5 years, the Immigration Services Agency will carefully assess whether there is a genuine need. This takes into account the fact that this status is intended for transferees and grants residence for a fixed period.
The Takashi administration has begun reviewing the criteria for residence statuses as part of its foreigner policy. In January, it decided to introduce a new requirement mandating Japanese language proficiency for obtaining “Permanent Resident” status. In October 2025, the government raised the capital requirement for the “Management and Administration” status—intended for foreign business owners—to six times the previous amount. It has been pointed out that the Intra-company Transfer status has lower barriers to entry compared to other statuses, such as having no educational requirements. By tightening the screening process, the government aims to prevent individuals without actual employment prior to arriving in Japan from staying as expatriates.
As of the end of 2025, there were approximately 20,000 foreign nationals residing in Japan under the Intra-company Transferee status. Among those coming to Japan on transfers, there are cases where individuals reside under statuses with stricter conditions than others, such as the Highly Skilled Professional category. The government’s policy is to actively accept foreign nationals who have passed rigorous screening, including highly skilled professionals.
The Intra-company Transferee status is used by foreign nationals working overseas who are transferred to work at a Japanese branch office. It is intended for white-collar jobs such as accounting and planning.
A similar status is the “Technical, Humanitarian, and International Services” (Tech-Human-Int'l) visa, which targets specialized professionals. Currently, there are over 470,000 holders of this status, making it the second most common residency status after “Permanent Resident.”
The government’s aim in tightening the screening process for the “Intra-company Transferee” status—which is considered relatively simple—is to prevent it from becoming a breeding ground for fraud. This move is intended to address cases where companies bring foreign nationals into the country under the guise of transfers that do not reflect actual work conditions, or have them engage in unskilled labor.
There are also reports that under the Gijinkokku status, it is not uncommon for foreign nationals to be employed in occupations such as manufacturing, which are not originally permitted. The capital requirement for the “Management and Administration” status was raised in 2025 because cases of foreign nationals residing in Japan through shell companies with no actual business operations were frequently observed.
The government plans to tighten residency requirements across the board to nip fraud in the bud. At the same time, it intends to actively accept foreign talent in specialized and technical fields. The “Highly Skilled Professional” status, granted to researchers who meet high standards in terms of academic background and annual income, is held by only about 30,000 people—less than 1% of the total foreign resident population.
A representative from the pharmaceutical industry commented on the stricter screening for intra-company transfers, saying, “The impact is likely to be minimal.” They added, “Global companies with offices around the world have already gone through the procedures necessary to secure residency in countries with stricter regulations, such as the U.S. and Europe.”

将严格审查居留期限。居留期限分为3个月、1年、3年和5年。若超过最长5年的期限,出入国在留管理厅将慎重判断是否存在必要性。需考虑到该资格是针对外派人员、以限定期限批准居留的性质。

政府之所以要加强对被认为审查相对简便的“企业内部调动”资格的审查,旨在未雨绸缪,防止其成为违规行为的温床。此举主要针对企业利用缺乏实际工作内容的调职名义让外国人入境,或安排其从事简单劳动的情况。
有观点指出,在“技术、人文知识、国际业务”在留资格下,让外国人从事本不被认可的制造业等职种的情况并不少见。2025年提高“经营、管理”在留资格的注册资本要求,正是因为时有发现通过名存实亡的空壳公司获得在留资格的案例。
此次将全面收紧居留资格审查,以铲除违规的苗头。同时,政府将积极引进专业技术领域的外国人才。目前,满足学历和年收入等高标准要求的科研人员所获得的“高度专业职”资格持有者约3万人,不足在日外国人总数的1%。
针对企业内部调动审查将趋于严格一事,医药行业相关人士表示:“影响应该不大。”并指出:“对于在全球各地设有分支机构的跨国企业而言,针对美国、欧洲等审查更为严格的国家所需的居留手续,它们早有经验。”
