製造業における技人国ビザの審査が2026年から厳格化される

2026年1月23日、政府は外国人の受け入れについて、秩序ある共生のための総合的対応策を決定した。この決定により製造業の現場の作業は特定技能で行うという方針がより明確化された。これまで製造業では、日本の大学や本国の理系大学を卒業した外国人を生産管理、品質管理CADエンジニアという名目で、技人国で採用するケースが一般的だった。しかし、実態としては、本来の専門業務ではなく、人手不足を補うために、製造業の現場に入って、組み立て、機械、オペレーター、各種検査などの単なる単純作業や現場レベルの管理をするケースがあった。これら機械加工、溶接、組み立て、検査など製造業の現場で作業は特定技能で行うことが厳格化される。生産ラインの進捗管理や品質管理についても、技人国では認められなくなる。

 特定技能には2種類のビザがあり、特定技能1号は製造業の現場スタッフということで、現場の最前線で機械操作や組み立て、検査等の製造業務を行う内容になる。特定技能2号は、現場のリーダー、責任者、班長、ライン長などのイメージになる。熟練した技能を持ち、複数のスタッフを指導管理するポジションになる。特定技能2号では家族帯同も認められる。技人国の業務は、本部の設計、生産管理エンジニアへのイメージになり、工場全体の生産計画を立てる、生産管理、不良品を減らすための品質保障システムの構築などが該当する。

 この変化は、派遣を受け入れている製造業の方に特に認識してもらう必要がある。製造業では人材派遣会社から外国人のエンジニアを受け入れている企業も多い。ここで注意してもらいたい事は派遣元がOKだと言っているからという理由で派遣されてきた技人国の外国人をライン作業などの単純作業に従事させる事は完全に違法になる。これまでは派遣会社の責任とされてきたが、今後は派遣先企業も不法就労助長罪に問われる可能性がある。最悪の場合5年以下の拘禁、または500万円以下の罰金が科され非常に重い犯罪になる。

 技人国で採用した外国人を半年から1年程度、各製造ラインをローテーションさせて、現場研修をすることが一般的にある。これが違法になるかという事については、明確なキャリアプランに基づき期間を決めた実務研修であれば、技人国ビザでも現場作業が認められる可能性がある。現場研修の後は、100%技人国該当性のある職務につかせることが必要である。とりあえず製造業の現場で長期間配置したいということであれば、まずは技人国ではなく特定技能で採用すべきである。その後本社の管理職や専任エンジニアになった段階で技人国に変更すればコンプライアンス上の問題はなくなる。今回の方針で現実に増えるリスクとしては、受け入れ期間に対して調査し、審査が厳格に運用されることになる。

 

Screening for Technical Intern Training Visas in the Manufacturing Sector to Become Stricter Starting in 2026

On January 23, 2026, the government adopted comprehensive measures for the orderly coexistence of foreign residents. This decision further clarified the policy that on-site manufacturing work should be performed under the Specific Skilled Worker visa program. Until now, it has been common in the manufacturing sector to hire foreign nationals under the “Technical/Human Resources/International” visa category for roles such as production management, quality control, and CAD engineering, particularly those who graduated from Japanese universities or science and engineering universities in their home countries. However, in reality, there have been cases where these individuals were not performing their original specialized duties but were instead assigned to the manufacturing floor to address labor shortages, performing simple tasks such as assembly, machine operation, and various inspections, or engaging in on-site management. The requirement that these manufacturing tasks—such as machining, welding, assembly, and inspection—be performed under the Specific Skilled Worker visa has been strictly enforced. Even production line progress management and quality control will no longer be permitted under the Technical Intern Training Program.

There are two types of Specific Skilled Worker visas. Specific Skilled Worker Type 1 is for on-site manufacturing staff, meaning they perform manufacturing tasks such as machine operation, assembly, and inspection on the front lines of the production floor. Specific Skilled Worker Type 2 corresponds to roles such as on-site leaders, supervisors, team leaders, and line managers. These are positions requiring skilled expertise and the ability to supervise and manage multiple staff members. Specific Skilled Worker Type 2 also permits family members to accompany the worker. “Technical/Human Resources/International” (Gijinkoku) roles correspond to positions such as design engineers or production management engineers at headquarters, and include tasks such as developing production plans for the entire factory, production management, and establishing quality assurance systems to reduce defective products.

 It is particularly important for manufacturers that currently accept temporary workers to be aware of this change. Many manufacturing companies hire foreign engineers through staffing agencies. It is crucial to note that assigning a foreign worker under the Technical/Human Resources/International category—even if the staffing agency gives approval—to perform simple tasks such as assembly line work is completely illegal. While this was previously considered the sole responsibility of the staffing agency, going forward, the client company may also be charged with aiding and abetting illegal employment. In the worst-case scenario, this constitutes a very serious crime punishable by up to five years’ imprisonment or a fine of up to 5 million yen.

It is common practice to rotate foreign workers hired under the Technical Intern Training Program through various production lines for approximately six months to one year as part of on-the-job training. As for whether this is illegal, if the duration is determined based on a clear career plan and the training is practical in nature, on-site work may be permitted even with a Technical Intern Training Program visa. After on-the-job training, it is necessary to assign them to a position that is 100% eligible under the Technical Intern Training Program. If the intention is to assign them to a manufacturing site for an extended period, they should first be hired under the Specified Skilled Worker visa, not the Technical Intern Training Program. Once they are promoted to a managerial position at headquarters or become a dedicated engineer, switching them to the Technical Intern Training Program will eliminate any compliance issues. Under this new policy, the practical risk is that investigations will be conducted regarding the duration of employment, and screening will be strictly enforced.

制造业的“特定技能”签证审查将于2026年起趋严

 2026年1月23日,政府就接纳外国人一事,决定了旨在实现有序共生的综合对策。该决定进一步明确了制造业一线作业应由“特定技能”人员承担的方针。此前,制造业中普遍存在以“生产管理”、“质量管理”或“CAD工程师”等名义,通过“技人国”签证招聘毕业于日本大学或本国理工科大学的外国人的情况。但实际情况是,这些人员并未从事本应从事的专业工作,而是为了弥补人手不足,进入制造业一线从事组装、机械操作、各类检测等单纯的体力劳动或基层管理工作。今后,机械加工、焊接、组装、检测等制造业现场作业将严格限定为“特定技能”范畴。生产线进度管理及质量管理等工作,也将不再被允许通过“技术/人文/国际”签证进行。

 “特定技能”签证分为两类,其中“特定技能1号”针对制造业一线员工,主要在生产一线从事机械操作、组装、检测等制造业务。特定技能2号则对应现场领班、负责人、组长、生产线主管等角色。该职位要求具备熟练技能,并负责指导和管理多名员工。特定技能2号允许携带家属。技人国(技术人员)的业务则对应总部层面的设计、生产管理工程师等角色,包括制定全厂生产计划、生产管理、构建旨在减少次品的质量保障体系等。

 这一变化,需要接受派遣的制造业企业特别予以关注。在制造业中,许多企业都从人才派遣公司接收外国工程师。这里需要注意的是,仅因派遣方表示同意,就让被派遣的“技人国”外国人从事生产线作业等简单劳动,是完全违法的。此前这被视为派遣公司的责任,但今后派遣企业也有可能被指控犯有“助长非法就业罪”。最坏情况下将面临5年以下监禁或500万日元以下罚金,属于非常严重的犯罪。

 通常情况下,企业会安排通过“技术人员”签证招聘的外国人,在各生产线上轮岗半年至一年左右进行现场培训。关于此举是否违法,如果培训期间是基于明确的职业规划确定的实务培训,即使持有“技术人员”签证,也有可能被允许从事现场作业。现场培训结束后,必须安排其从事100%符合“技术人员、专家及国际人才”类别的职务。如果暂时希望在制造业现场长期安排人员,首先应通过“特定技能”而非“技术人员、专家及国际人才”进行招聘。待其晋升为总部的管理职或专职工程师后,再变更为“技术人员、专家及国际人才”签证,即可避免合规问题。根据此次政策调整,实际增加的风险在于,针对接收期间将进行调查,且审查将得到严格执行。
