安全保障上重要な土地取得、国籍問わず規制へ
政府は安全保障上重要な土地の売買を規制する検討に入った。自衛隊の基地など政府が重要施設と認めた設備の周囲の土地などを対象とする方向だ。売り手、買い手の国籍に関係なく規制の対象とする方針で法改正を進める。
規制対象を外国人に絞ると国際ルールとの整合性が課題となるため、国籍を問わず一律で規制する。規制の対象や内容は与党などの議論を踏まえて調整する。
届け出方式から厳格化
政府は2021年に、取得の際に届け出が必要な「重要土地等調査法」を制定した。自衛隊の基地や原子力発電所などの周辺の土地を売買する際に用途や購入者の国籍を内閣府に提出する。企業が取得する場合は株主の国籍も報告を義務づけた。
自民党内では規制対象に海底ケーブルなどを加えるべきだとの声が出ている。重要施設の周囲1キロメートル以内という対象範囲の拡大論もある。
現状は届け出で足りるが、政府が申請内容を審査する「許認可制」への移行を視野に入れる。外国人の土地取得に関する政府の有識者会議で議論し骨格を設計する。26年夏までに取りまとめる。許認可の具体的な方法は今後、詰める。
高市早苗政権は26年1月に外国人の土地取得のルールのあり方を検討課題に挙げたものの、国籍を限定して規制するのは難しいと判断した。世界貿易機関(WTO)加盟国が結ぶサービス貿易に関する一般協定(GATS)が理由とされる。
GATSは国内外の企業などの活動条件を平等にする「内国民待遇」を定めている。この規定に基づき、日本は外国人による不動産の所有や賃貸借に規制を原則としてかけていない。外国人だけを対象とする土地取得の規制は難しい。
重要土地等調査法の対象を超えるものを規制する場合は新法の創設も視野に入れる。自民党内には、離島やマンションなどを規制の対象にできないか探る意見もある。
政府は17年に領海や排他的経済水域(EEZ)を決める基点となる273の国境離島を国有化した。対象は所有者が不明、または存在しないと国が認めた離島に限定した。
国境以外で所有者が不明の離島に優先順位をつけて、必要があれば国有化を検討する。所有者が明確であっても安保の観点から、取引のルール整備が必要か検討する。
マンションは都市部での価格高騰の原因が外国人の短期売買だとする指摘がある。実態把握を進め、必要に応じて価格高騰を抑制するルール整備をめざす。
国土交通省の調査によると、国外に住所のある購入者が25年1〜6月に不動産登記した物件は、東京都心で7.5%、東京23区では3.5%だった。23区での国外からの取得は台湾が6割、中国が1割ほどだった。
政府はマンション購入者の国籍の把握を進める。法務省は10月から不動産登記の申請書に国籍を記入する欄を設け、義務化する。デジタル庁は国籍情報を政府内で共有するデータベースを27年度にも整備する。
Regulations to Be Imposed on Acquisition of Land Critical to National Security, Regardless of Nationality
The government has begun considering regulations on the sale and purchase of land critical to national security. The focus is expected to be on land surrounding facilities designated by the government as critical infrastructure, such as Self-Defense Forces bases. The government plans to proceed with legislative amendments to impose these regulations regardless of the nationality of the seller or buyer.
Since limiting the scope of the regulations to foreigners would raise issues regarding consistency with international rules, the regulations will apply uniformly to all parties, regardless of nationality. The scope and details of the regulations will be finalized based on discussions within the ruling party and other stakeholders.
Moving from a notification system to stricter controls
In 2021, the government enacted the “Act on the Survey of Important Land, etc.,” which requires notification upon acquisition. When land surrounding facilities such as Self-Defense Forces bases or nuclear power plants is bought or sold, the intended use and the buyer’s nationality must be reported to the Cabinet Office. If a corporation acquires the land, it is also required to report the nationalities of its shareholders.
Within the Liberal Democratic Party (LDP), there are calls to expand the scope of regulation to include undersea cables and other infrastructure. There are also proposals to extend the coverage area to within one kilometer of critical facilities.
While a notification system is currently sufficient, the government is considering a transition to a “permit system” in which the government reviews application details. A government panel of experts on foreign land acquisition will discuss and design the framework, with a plan to be finalized by the summer of 2026. Specific details regarding the permit system will be worked out in the future.
Although the Takaichi Sanae administration identified the rules governing foreign land acquisition as an issue for review in January 2026, it determined that it would be difficult to impose restrictions based solely on nationality. This is attributed to the General Agreement on Trade in Services (GATS), an agreement on trade in services signed by World Trade Organization (WTO) member states.
GATS stipulates “national treatment,” which requires equal conditions for domestic and foreign companies and other entities. Based on this provision, Japan generally does not impose restrictions on real estate ownership or leasing by foreigners. It is difficult to implement land acquisition regulations targeting only foreigners.
If regulations are to be imposed on properties beyond the scope of the Important Land Survey Act, the creation of a new law will also be considered. Within the Liberal Democratic Party, there are opinions exploring whether remote islands and condominiums could be included as targets for regulation.
In 2017, the government nationalized 273 remote border islands that serve as basepoints for defining territorial waters and exclusive economic zones (EEZs). The scope was limited to islands where the government determined that the owner was unknown or did not exist.
The government will prioritize remote islands outside these border areas where the owner is unknown and consider nationalization if necessary. Even where the owner is clear, the government will examine whether rules governing transactions are needed from a national security perspective.
There are claims that short-term buying and selling by foreigners is a cause of soaring apartment prices in urban areas. The government aims to assess the actual situation and, if necessary, establish rules to curb price surges.
According to a survey by the Ministry of Land, Infrastructure, Transport and Tourism, properties registered in the real estate registry between January and June 2025 by buyers residing overseas accounted for 7.5% in central Tokyo and 3.5% in the 23 wards of Tokyo. Of the properties acquired by foreign buyers in the 23 wards, about 60% were purchased by Taiwanese nationals and about 10% by Chinese nationals.
The government is working to track the nationalities of condominium buyers. Starting in October, the Ministry of Justice will require a field for nationality on real estate registration applications. The Digital Agency plans to establish a database for sharing nationality information within the government as early as fiscal year 2027.

据国土交通省调查显示,2025年1月至6月期间,在东京都心区,由境外住所的购房者办理房地产登记的房产占7.5%,在东京23区则占3.5%。在23区,来自海外的购房者中,台湾占6成,中国约占1成。
政府将推进对公寓购房者国籍的掌握。法务省将于10月起在不动产登记申请表中增设国籍填写栏,并将其列为强制要求。数字厅计划在2027年度内建立一个在政府内部共享国籍信息的数据库。
