成年後見制度がより利用しやすく変わる

4月3日、政府は閣議で認知症や知的障害などで判断能力が充分ではない人たちを支える成年後見制度を利用しやすくする民法改正案を決定した。利用を途中で終了したり、遺産分割など特定の行為に限って支援したりできるようになる。2028年度中にも新制度の運用が始まる。

 成年後見制度は、2000年、認知症患者などの判断能力が不十分の人に代わり、預貯金の管理や契約を支援する仕組みとして導入された。改正案では、当事者の状況変化に合わせて制度の使い勝手を良くすることに主眼が置かれている。家庭裁判所が認めれば制度の理由を途中で終えることができる規定が新設される。これまでは終身利用が原則で判断能力が回復するか、本人がなくなるまで利用を止めることができなかった。遺産分割や不動産の処分といった特定の行為に限って、支援できるような制度も盛り込まれる。つまり利用者のニーズに合った活用ができるようになる。成年後見制度は、本人の判断能力に応じて保護の必要性が高い順に後見、保佐、補助の3段階がある。改正後は補助に一本化される。

 法改正の背景は急速な高齢化だ。65歳以上の人口が日本全体に占める割合は30%程度まで高まっている。家族に頼れない単身世帯も増えている。65歳以上の高齢者の単身世帯は2023年時点で855万世帯と全世帯の約16%を占めている。身寄りのない高齢者の財産管理を支える制度づくりが急務になっている。改正案では遺言をパソコンなどで作成できる「デジタル遺言書」の導入もされることになった。法務省が利用者から提出を受け、本人確認をした上で遺言書のデータを保管します。本人の意思に基づいて作成したと確認するため、保管を申請する際に遺言の全文の口述を求める。

Changes to Make the Adult Guardianship System More Accessible

On April 3, the government approved a draft amendment to the Civil Code during a cabinet meeting aimed at making the adult guardianship system—which supports people with insufficient decision-making capacity due to dementia, intellectual disabilities, or other reasons—more accessible. The amendment will allow guardianship to be terminated mid-term and enable support to be limited to specific actions, such as the division of an estate. The new system is scheduled to go into effect during fiscal year 2028.

 The adult guardianship system was introduced in 2000 as a mechanism to assist individuals with insufficient decision-making capacity, such as those with dementia, by managing their savings and supporting them in entering into contracts. The proposed amendments focus on improving the system’s usability to adapt to changes in the individual’s circumstances. A new provision will be established allowing the system to be terminated mid-term if approved by the Family Court. Until now, the principle was lifelong use, and the arrangement could not be terminated until the individual’s decision-making capacity was restored or the person passed away. The revised system will also include provisions allowing support to be limited to specific actions, such as the division of an estate or the disposal of real estate. In other words, the system will be able to be utilized in ways that better meet the needs of the user. The adult guardianship system currently has three tiers—guardianship, curatorship, and assistance—arranged in order of the level of protection required based on the individual’s decision-making capacity. After the revision, the system will be streamlined into a single tier: assistance.

 The background to these legal amendments is Japan’s rapidly aging population. The proportion of people aged 65 and older has risen to about 30% of the total population. The number of single-person households that cannot rely on family support is also increasing. As of 2023, there were 8.55 million single-person households headed by people aged 65 and older, accounting for approximately 16% of all households. Creating a system to support the asset management of elderly people without relatives has become an urgent priority. The amendment also includes the introduction of “digital wills,” which allow individuals to create wills using computers or other devices. The Ministry of Justice will receive submissions from users, verify their identities, and store the will data. To confirm that the will was created in accordance with the individual’s true intentions, applicants will be required to dictate the full text of the will when applying for storage.

4月3日,政府在内阁会议上通过了《民法》修正案,旨在使支持因认知症或智力障碍等原因而判断能力不足人群的成年监护制度更易于使用。该修正案允许在中途终止监护,或仅针对遗产分割等特定行为提供支持。新制度预计将于2028年度内开始实施。

 成年监护制度于2000年作为一项机制引入,旨在代替患有认知症等判断能力不足的人士,协助管理存款及签订合同。此次修订案的重点在于根据当事人的情况变化,提升制度的便利性。新设了经家庭法院认可后,可在中途终止该制度的条款。此前原则上需终身使用,除非判断能力恢复或本人去世,否则无法停止使用。此次修订还将纳入仅针对遗产分割或不动产处置等特定行为提供支持的制度。也就是说,将能够根据使用者的需求灵活运用。成年监护制度根据本人的判断能力,按保护必要性从高到低分为监护、保佐、辅助三个阶段。修订后将统一为辅助。

 此次法律修订的背景是人口老龄化加速。65岁以上人口占日本总人口的比例已升至约30%。无法依靠家人的单身家庭也在增加。截至2023年,65岁以上老年人的单身家庭达855万户,约占全国家庭总数的16%。建立支持无亲属老年人财产管理的制度已成为当务之急。修订案中还决定引入可通过电脑等设备制作的“数字遗嘱”。法务省将接收用户提交的遗嘱,在确认身份后保管遗嘱数据。为了确认遗嘱是根据本人意愿制作的,在申请保管时将要求口述遗嘱全文。
