企業の外国人転勤者の在留審査厳正になる

政府は民間企業の外国人職員が日本に転勤する際の在留資格の審査を厳正にする。来日前に勤めていた事業所や本人の勤務の実態に関する資料の提出を求め、調べる。高市早苗政権は在留外国人の適切な管理をめざし資格審査全般を厳しくしている。

外国人が中長期で日本に滞在する場合、目的に応じて在留資格を取る必要がある。出入国在留管理庁は4月から在留資格の一つ「企業内転勤」の運用の見直しを始めた。国内外の企業の外国人職員が主な対象になる。申請者に見直しを通知した。

新たに①外国での社会保険加入の証明②外国の事業所の法人登記や納税状況③日本での事業所の登記簿や写真――といった資料の提出を義務付ける。これまでは資格の審査時に在留証明書やパスポートなどを出す必要があった。

税の申告のチェックを厳しくする。外国人の職員によっては日本国外から給与が支払われていると主張して、必要な税の申告を怠る例があった。今後は不適切な手続きが判明した場合、原則として資格の更新を認めないようにする。

在留の期間の審査も厳正にする。3カ月、1年、3年、5年がある。最長の5年を超える場合、必要性があるかどうかを出入国在留管理庁が慎重に判断する。期間を定めて在留を認める転勤者向けの資格である点を踏まえる。

 高市政権は外国人政策として在留資格の基準見直しに着手している。1月に「永住」の資格を取る際に日本語能力を求める要件を新設すると決めた。2025年には外国人経営者の在留資格「経営・管理ビザ」の要件として資本金を6倍に引き上げた。

企業内転勤は学歴の要件がないなど他の資格に比べて取得のハードルが低いとの指摘があった。審査を厳しくすることで来日前に勤務の実態のない人が駐在員として在留することがないようにする。

企業内転勤の資格で在留する外国人は25年末でおよそ2万人いる。転勤で日本に来る人の中には他の資格より厳しい条件を設けている高度専門職などで在留する例もある。政府は高度人材を含め厳しい審査を経た外国人は積極的に受け入れる方針だ。

Stricter Screening for Foreign Employees Transferred to Japan

The government will tighten the screening process for residence status for foreign employees of private companies who are transferred to Japan. It will require the submission of documents regarding the workplace where the individual was employed prior to coming to Japan and the actual details of their work, and will conduct investigations. The Takaichi Sanae administration is tightening overall screening procedures for residence status with the aim of ensuring proper management of foreign residents.

Foreign nationals staying in Japan for the medium to long term must obtain a residence status appropriate to their purpose. Starting in April, the Immigration Services Agency began revising the implementation of the “Intra-company Transferee” residence status. This primarily targets foreign employees of companies both in Japan and abroad. Applicants have been notified of the revisions.

New requirements mandate the submission of the following documents: (1) proof of social insurance enrollment in the foreign country; (2) corporate registration and tax payment records for the foreign business office; and (3) registration records and photographs of the business office in Japan. Previously, applicants were only required to submit a Certificate of Residence and a passport during the status review process.

Tax filing checks will be tightened. There have been cases where foreign employees claimed their salaries were paid from outside Japan and failed to file the necessary tax returns. Going forward, if improper procedures are discovered, status renewal will generally not be granted.

Reviews of the duration of stay will also be conducted more strictly. Options include 3 months, 1 year, 3 years, and 5 years. For stays exceeding the maximum 5-year period, the Immigration Services Agency will carefully assess whether there is a necessity for the extension. This takes into account the fact that this status is intended for transferees and grants residence for a fixed period.

 The Takashi administration has begun reviewing the criteria for residence statuses as part of its immigration policy. In January, it decided to introduce a new requirement mandating Japanese language proficiency for those applying for “Permanent Resident” status. In 2025, it raised the capital requirement for the “Management and Administration Visa”—a residence status for foreign business owners—to six times the previous amount.

It has been pointed out that the Intra-Company Transferee status has lower barriers to entry compared to other statuses, such as having no educational requirements. By tightening the screening process, the government aims to prevent individuals who have no actual employment in Japan prior to their arrival from staying as expatriates.

As of the end of 2025, there were approximately 20,000 foreign nationals residing in Japan under the intra-company transfer status. Among those coming to Japan on transfers, there are cases where they reside under statuses with stricter conditions than others, such as the Highly Skilled Professional status. The government’s policy is to actively accept foreign nationals who have passed rigorous screening, including highly skilled professionals.

对企业外籍调职人员的居留审查将趋于严格

 政府将加强对私营企业外籍员工赴日调职时的居留资格审查。将要求提交关于来日之前任职单位及本人实际工作情况的资料,并进行核查。高市早苗政府旨在对在日外国人进行妥善管理,正全面收紧居留资格审查。

外国人若需在中长期内居留日本,必须根据目的申请相应的居留资格。出入国在留管理厅自4月起开始重新审视“企业内部调职”这一居留资格的实施细则。主要对象为国内外企业的外籍员工。该厅已向申请人发出了相关通知。

新规要求必须提交以下资料:①在国外参加社会保险的证明;②国外分支机构的法人登记及纳税情况;③日本分支机构的登记簿及照片。此前,在资格审查时仅需出示在留证明书或护照等文件。

将加强税务申报的核查力度。此前曾有部分外籍员工声称工资由日本境外支付,从而怠于履行必要的税务申报义务。今后若发现存在不当手续,原则上将不予批准资格更新。

居留期限的审查也将更加严格。居留期限分为3个月、1年、3年和5年。若超过最长的5年期限,出入国在留管理厅将慎重判断是否确有必要。需考虑到该资格是针对外派人员、以限定期限批准居留的性质。

 高市政权已着手重新审视居留资格标准作为其外国人政策的一部分。1月决定,申请“永住”资格时将新增日语能力要求。2025年,针对外国经营者的“经营·管理签证”资格,其注册资本要求已提高至原来的6倍。

有观点指出,与其他资格相比,企业内部调职资格因无学历要求等原因,获取门槛较低。通过加强审查,旨在防止在赴日前没有实际工作经历的人以驻在员身份居留。

截至2025年底,持企业内部调职资格居留的外国人约有2万人。在因调职来日的人员中,也有持“高度专业职”等比其他资格条件更严格的标准居留的案例。政府方针是积极接纳包括高素质人才在内、经过严格审查的外国人。
