永住権に関する大きな変化

今後、永住権に関して、3つの重要な変化があります。

  1. 入管法第22条に基づく永住許可のガイドラインには、引き続き10年以上梱包に滞留していることと言う文言があります。しかしその内側には全く別の要件があります。それは10年のうち、直近5年間は就労資格または居住資格で在留していなければならないことです。ここで重要なのは、技能実習や特定技能1号として過ごした期間は、この5年間のカウントから明確に除外される。つまり日本のために働いて税金も収めて、10年間在留していても、そのうちの大半が技能実習や特定技能1号だった場合、永住権の要件すら満たしていないことになります。育成労働からスタートする一般的な労働者の場合は、育成で3年間在留した後、特定技能1号に移行して最大5年間、この特定技能1号の期間は永住申請に必要な就労での5年にカウントされません。その後特定技能2号に移行してさらに5年間の就労実績を積んで、ようやく永住申請の入り口に立てます。
  2. 納税公的義務の完全な履行が求められます。新基準では審査当局が過去5年分の納税履歴書類をもとに徹底的に精査を行います。住民税所得税固定資産税といった税金はもちろん、国民年金、公的医療保険の保険料も対象です。ここでは払ったかということではなく、納付期限内に払ったかどうかが問われます。つまり1日の遅延も1円の不足も、公的義務を適正に履行していないことになります。申請者が提出しなければいけない書類の中には、年金の納付記録が2年分以上、住民税の課税証明書、納税証明書が直近5年分含まれます。
  3. 申請手数料が大幅に引き上げになります。現在永住許可申請は8000円だが、それが新法下では、上限300,000円まで引き上げられます。更新手数料も現在の4000円から上限100,000円に引き上げられます。
  4. 永住許可の取り消し制度の新設されます。2027年4月から施工が予定されているこの制度では永住権を一度取っても、取り消されることがあるということです。法務大臣は永住者が故意に納税や社会保険料の支払いを怠った場合、永住許可を取り消すことができるようになります。20年前に永住権を取った人もこれからは完璧なコンプライアンスが求められます。専門家が推奨するのは住民税や国民年金、国民健康保険の口座振替または給与天引きへの切り替えです。住所変更の届出義務違反も取り消し事由になります。引っ越しをしたら、14日以内に市区町村役場に届けなければなりません。

Major Changes Regarding Permanent Residency

There will be three significant changes regarding permanent residency moving forward.

1. The guidelines for permanent residency permits under Article 22 of the Immigration Control Act still include the requirement that an applicant must have resided in Japan for at least 10 years. However, there is a completely different requirement hidden within this provision: the applicant must have resided in Japan under a work or residence status for the most recent 5 years of those 10 years. The key point here is that periods spent under the Technical Intern Training Program or Specific Skilled Worker Type 1 are explicitly excluded from this five-year count. In other words, even if you have worked for Japan, paid taxes, and resided in the country for 10 years, if the majority of that time was spent under the Technical Intern Training Program or Specific Skilled Worker Type 1, you will not even meet the requirements for permanent residency. For typical workers starting in the Training Program, after residing for three years under that program, they transition to Specific Skilled Worker Type 1 for up to five years. This period under Specific Skilled Worker Type 1 does not count toward the five years of employment required for a permanent residency application. After that, they transition to Specific Skilled Worker Type 2 and accumulate another five years of employment history before they can finally qualify to apply for permanent residency.

2. Full compliance with public tax obligations is required. Under the new standards, the reviewing authorities will conduct a thorough examination based on tax payment records for the past five years. This includes not only taxes such as resident tax, income tax, and property tax, but also premiums for the National Pension and public health insurance. The focus here is not merely on whether payments were made, but whether they were made by the due date. In other words, even a one-day delay or a one-yen shortfall constitutes a failure to properly fulfill public obligations. The documents applicants must submit include pension payment records covering at least two years, as well as resident tax assessment certificates and tax payment certificates for the most recent five years.

3. Application fees will be significantly increased. Currently, the application fee for permanent residency is 8,000 yen, but under the new law, it will be raised to a maximum of 300,000 yen. The renewal fee will also be raised from the current 4,000 yen to a maximum of 100,000 yen.

4. A new system for revoking permanent residency will be established. Under this system, scheduled to take effect in April 2027, permanent residency can be revoked even after it has been granted. The Minister of Justice will be able to revoke a permanent resident’s status if the individual intentionally fails to pay taxes or social insurance premiums. Even those who obtained permanent residency 20 years ago will now be required to maintain perfect compliance. Experts recommend switching to direct debit or payroll deduction for resident tax, national pension, and national health insurance payments. Failure to report a change of address is also grounds for revocation. If you move, you must notify your local municipal office within 14 days.

关于永住权的重要变化

 今后,关于永住权将有以下三项重要变化。

1. 根据《入管法》第22条制定的永住许可指南中,仍包含“在日本连续居留10年以上”这一表述。但其中还包含另一项完全不同的要件,即在这10年中,最近5年必须是以工作资格或居住资格在日本居留。这里的关键在于,作为技能实习或特定技能1号身份度过的期间,明确不计入这5年的计算范围。也就是说,即使为日本工作并纳税、在日居留了10年,但如果其中大部分时间是作为技能实习或特定技能1号身份度过的,那么就连永住权的条件都无法满足。对于从培训型劳动开始的一般劳动者而言,在培训期间居留3年后,转为特定技能1号并最多居留5年,而这段特定技能1号的期间不计入申请永住权所需的5年工作年限。之后转为特定技能2号,再积累5年的工作实绩,才能终于站上申请永住权的起跑线。

2. 必须完全履行纳税等公共义务。根据新标准,审查机构将依据过去5年的纳税记录文件进行彻底审查。不仅包括居民税、所得税、固定资产税等税款,国民年金和公共医疗保险的保险费也在审查范围内。这里考察的并非是否缴纳了税款,而是是否在缴纳期限内完成缴纳。也就是说,哪怕延迟一天或短缺一円,都视为未妥善履行公共义务。申请人必须提交的文件中,包括2年以上的年金缴纳记录、最近5年的居民税课税证明书及纳税证明书。

3. 申请手续费将大幅上调。目前永住许可申请费为8000日元,但在新法下,该费用上限将提高至300,000日元。更新手续费也将从目前的4000日元提高至上限100,000日元。

4. 将新设永住许可撤销制度。该制度预计于2027年4月起实施,这意味着即使已获得永住权,也可能被撤销。若永住者故意拖欠纳税或社会保险费,法务大臣将有权撤销其永住许可。即便是20年前已获得永住权的人,今后也必须严格遵守相关规定。专家建议将居民税、国民年金及国民健康保险的缴纳方式改为银行账户自动扣款或工资代扣。违反住所变更申报义务也将构成撤销事由。搬家后,必须在14天内向市、区、町、村政府申报。
