登録支援機関と行政書士の業務範囲の違い

外国人の方が、ビザ申請と更新に関して依頼する時、登録支援機関に依頼するか、行政書士に依頼するか判断に迷うことがあると思います。しかし、2者の役割(あるいは法的資格)は全く異なります。

ビザ申請あるいは更新は、基本的に自身で行うか行政書士や弁護士に代行してもらう必要があります。登録支援機関ではビザ申請や更新の書類を作成することはできません。これは法律で明確に定められています。

登録支援機関は、特定技能外国人の支援が業務になります。これは、ビザ提出時に提出する支援計画に沿って、日本での生活のオリエンテーション、日本語学習の支援、生活の困りごとへのサポートなどになります。この分野は、行政書士は行うことができません。

例外的に、行政書士事務所で登録支援機関の要件を満たし登録支援機関になっている場合は、両方の業務をすることができます。

Differences in the Scope of Services Between Registered Support Organizations and Administrative Scriveners

When foreign nationals need assistance with visa applications or renewals, they may find it difficult to decide whether to seek help from a Registered Support Organization or an Administrative Scrivener. However, the roles (or legal qualifications) of these two entities are entirely different.

Visa applications and renewals must generally be handled by the applicant themselves or delegated to an Administrative Scrivener or attorney. Registered Support Organizations are not permitted to prepare visa application or renewal documents. This is clearly stipulated by law.

The primary role of a Registered Support Organization is to provide support to foreign workers with Specific Skilled Worker visas. This includes orientation on life in Japan, support for Japanese language learning, and assistance with daily living challenges, all in accordance with the support plan submitted at the time of visa application. Administrative scriveners are not permitted to perform these services.

As an exception, if an administrative scrivener’s office meets the requirements to become a Registered Support Organization, it may perform both types of services.

注册支援机构与行政书士的业务范围差异

外国人在委托办理签证申请及更新手续时，可能会犹豫是委托注册支援机构还是行政书士。然而，两者的职责（或法律资格）截然不同。

签证申请或更新原则上需由本人亲自办理，或委托行政书士、律师代为办理。注册支援机构无法制作签证申请或更新的相关文件。这一点在法律上已有明确规定。

注册支援机构的业务是支援特定技能外国人。这包括根据提交签证申请时提交的支援计划，提供在日本生活的入职指导、日语学习支援以及生活困难的协助等。这一领域是行政书士无法开展的。

例外情况是，如果行政书士事务所满足注册支援机构的要件并已成为注册支援机构，则可以同时开展这两方面的业务。
