派遣技人国ビザが厳格化される

これまでは派遣元だけが審査の対象でしたが、これからは派遣先も審査されることになります。

5つの変更点は以下のとおりです。

  1. 派遣元、派遣先双方の責任者が署名する誓約書が必須になる。

絶対に単純労働をさせない、入管の調査に協力することの誓約が必要になる。

  1. 申請時点で派遣先の確定が必要になる。

これまでは、派遣会社でビザを取得更新をして、その後に派遣先を探すことが可能であったが、今後は派遣先が確定して、具体的な業務内容の証明が必要になる。

  1. 在留期間が派遣契約期間に連動するようになる。
  2. 入管の派遣先への直接確認、実地調査が実施される。
  3. ビザ更新時の提出書類が大幅に増加する。

  派遣元台帳、派遣先管理台帳、就業状況報告書が追加で求められるようになる。

入管の意図は、申請時だけでなく、許可後に適切に業務を行っているか、労働者派遣法を遵守して単純労働をさせていないか、申請時の誓約書にに基づき厳しくチェックしようとしている。ここで矛盾、虚偽が発見されれば、更新不許可、ビザの取り消し、企業側の罰則にもつながります。

厳格化の背景は、技人国ビザを取得しているにも関わらず、派遣という形態を悪用して、単純労働を行っているケースが後を立たないことがあります。技人国とは、大学等で学んだ専門的、技術的な知識を必要とするエンジニア、通訳、マーケティングのみに従事できる資格です。

派遣元、派遣先が負うリスクと今後の対策は以下のとおりです。

派遣元が注意すべき点は、派遣先で単純労働をさせていたことが発覚したら、今後の外国人派遣事業ができなくなり、新たなビザ申請が降りなくなります。派遣元が不法就労助長罪に問われるリスクもあります。

派遣先が注意すべき点は、派遣元から「少しなら現場作業をしても大丈夫と言われた」という言い訳は通用しなくなります。派遣先企業も不法就労助長罪に問われるリスクがあります。不法就労助長罪は厳罰化されており、現在は5年以下の拘禁刑または500万円以下の罰金になります。

派遣先は、外国人のビザをチェックし、技人国であった場合は、任せる仕事が本当に専門知識が必要であるかを自身で確認する必要があります。また、工場長や店長などの現場責任者へは、この外国人スタッフには現場を手伝わせてはいけないと、徹底した指示が必要です。

2026年3月9日以降は、技人国ビザは安易な労働力確保手段としては使えなくなります。制度を正しく理解して、適法な運用体制を作らなければ、企業が大きなダメージを受けます。

派遣元企業、派遣先企業ともに、現在の派遣契約や実際の業務内容が入管の審査基準に適合しているかどうか、コンプライアンスチェックが必要になります。

Tightening of the Technical Intern Training Visa

Previously, only the dispatching agency was subject to screening, but from now on, the host company will also be screened.

The five changes are as follows:

1. A written pledge signed by the responsible parties at both the dispatching agency and the host company will be required.

This pledge must include a commitment to absolutely not assign the trainee to unskilled labor and to cooperate with immigration investigations.

2. The client company must be confirmed at the time of application.

Previously, it was possible for the staffing agency to obtain or renew the visa and then find a client company, but going forward, the client company must be confirmed, and proof of specific job duties will be required.

3. The period of stay will be linked to the duration of the staffing contract.

4. Immigration authorities will conduct direct verification and on-site inspections of client companies.

5. The number of documents required for visa renewal will increase significantly.

  Additional documents such as the Dispatching Company Register, Client Company Management Register, and Employment Status Report will be required.

The Immigration Bureau’s intention is to conduct strict checks—not only at the time of application but also after approval—to ensure that work is being performed appropriately, that the Worker Dispatch Act is being followed, and that workers are not being assigned to unskilled labor, all in accordance with the pledge submitted at the time of application. If any contradictions or falsehoods are discovered, this may result in denial of renewal, revocation of the visa, and penalties for the company.

The reason for this tightening is the persistent occurrence of cases where companies, despite holding Technical Intern Training visas, abuse the temporary staffing system to engage workers in unskilled labor. The Technical Intern Training visa is a qualification that allows holders to engage exclusively in engineering, interpretation, or marketing roles requiring specialized or technical knowledge acquired at universities or similar institutions.

The risks faced by staffing agencies and client companies, along with future countermeasures, are as follows:

Staffing agencies must be aware that if it is discovered they have allowed foreign workers to perform unskilled labor at a client site, they will be barred from future foreign worker dispatch operations and will no longer be able to obtain new visa approvals. There is also a risk that the agency could be charged with aiding and abetting illegal employment.

Client companies must be aware that excuses such as “the staffing agency told us it was okay to do a little on-site work” will no longer be accepted. Client companies also face the risk of being charged with aiding and abetting illegal employment. Penalties for this offense have been strengthened and currently carry a prison term of up to five years or a fine of up to 5 million yen.

Client companies must verify the foreign worker’s visa status. If the worker holds a Technical/Humanities/International Services visa, the client must independently confirm that the assigned work genuinely requires specialized knowledge. Furthermore, it is essential to issue strict instructions to on-site supervisors, such as factory managers or store managers, explicitly prohibiting these foreign staff members from assisting with on-site operations.

After March 9, 2026, the Technical/Humanities/International Services visa will no longer be available as a convenient means of securing labor. If companies fail to properly understand the system and establish a compliant operational framework, they will suffer significant damage.

Both the staffing agency and the client company must conduct compliance checks to ensure that current staffing contracts and actual job duties comply with the Immigration Bureau’s review criteria.

派遣技术人员签证政策趋严

此前仅派遣方需接受审查,今后派遣接收方也将纳入审查范围。

具体变更点如下:

1. 必须提交由派遣方和派遣接收方双方负责人签署的承诺书。

必须承诺绝不安排从事简单劳动,并配合入境管理局的调查。

2. 申请时必须确定派遣接收方。

此前,派遣公司可在取得或更新签证后才寻找派遣接收方,但今后必须在确定派遣接收方后,提供具体业务内容的证明。

3. 居留期限将与派遣合同期限挂钩。

4. 入管将对派遣接收方进行直接确认及实地调查。

5. 签证更新时需提交的文件将大幅增加。

  将新增要求提交派遣方台账、派遣单位管理台账及就业状况报告书。

入管局旨在不仅在申请时,更要在许可后严格核查是否妥善履行业务,是否遵守《劳动者派遣法》避免安排从事简单劳动,并依据申请时的誓约书进行严格审查。若发现矛盾或虚假情况,将导致更新申请被拒、签证被撤销,并可能对企业方处以处罚。

政策收紧的背景在于,尽管已取得“技术/人类/国际”签证,却滥用派遣形式从事简单劳动的案例屡见不鲜。“技术/人类/国际”签证是仅限从事工程师、翻译、市场营销等需要运用大学等所学专业及技术知识的职业的资格。

派遣方与用工方所承担的风险及今后的对策如下:

派遣方需注意的是,一旦被发现让外籍员工在用工方从事简单劳动,今后将无法继续开展外籍人员派遣业务,且新签证申请也将无法获批。派遣方还可能面临被指控“教唆非法就业罪”的风险。

用工方需注意的是,“派遣方曾表示‘稍微做些现场作业也没关系’”这一借口将不再成立。用工单位同样面临被指控“助长非法就业罪”的风险。该罪名已加重处罚,目前处以5年以下有期徒刑或500万日元以下罚金。

用工单位必须核查外国人的签证类型,若为“技人国”签证,需自行确认所分配的工作是否确实需要专业知识。此外,必须向工厂长、店长等现场负责人下达彻底的指示,明确禁止让该外国员工协助现场工作。

2026年3月9日之后,“技术、劳务及管理”签证将无法再作为获取劳动力的便捷手段。若未能正确理解制度并建立合法的运营体系,企业将遭受重大损失。

无论是派遣方企业还是用工方企业,都必须对现有的派遣合同及实际业务内容是否符合入管审查标准进行合规性检查。
