技人国の審査が厳格化する

2026年から入管は技人国の審査を厳格化しています。技人国の3つの条件は以下の通りです。

1つ目は在留資格の該当性、2つ目は上陸許可基準適合性、3つ目は相当性です。

在留資格該当制とは、その外国人がやろうとしている活動が、技人国という在留資格の定義に当てはまるかということです。条文には、本邦の公私の機関との契約に基づいて行う、と記載されています。この契約とは雇用契約、業務委託契約等を意味します。業務内容については、技術、人文知識、国際業務に分けて説明します。技術は、理学、工学、農学、医学、薬学などいわゆる理系の専門知識、技術を要する業務になります。主な職種としては、システムエンジニア、プログラマー、機械設計者、科学研究員、建築設計士などが該当します。人文知識とは、法律、経済、社会、文学、語学など文系の知識を要する業務になります。主な業種は、経営企画、マーケティング、貿易事務、法務、コンプライアンス、会計、財務等が該当します。今問題になっているのが携帯ショップとかで外国人の方が受付をやっているケースです。携帯電話を販売するだけの業務がこの技人国に該当するかどうかです。未経験の方でも1 、2年経験を積めば携帯の販売ができるんではないかということです。この辺が限界ラインになると思います。国際業務は、翻訳、通訳、語学の指導、広報、宣伝または海外取引業務、服飾、室内装飾に関わるデザイン、商品開発、その他これらに類似する業務ということです。

単純労働の境界線については、一般的には反復定形型の作業で、専門知識がなくても、一定の訓練で遂行できる業務は単純労働になります。製造現場で生産管理、品質管理という名目であっても、実態としてはラインでの組み立て、機械操作、目視検査を兼務しているようであれば、該当性がなく不許可になります。いわゆる現場の職長や現場のリーダー業務は特定技能2号の役割とされています。技人国で現場監督をするのは、不法就労助長罪に問われるリスクがあります。ホテルや旅行業では、通訳案内や海外向けのウェブサイトの翻訳企画業務は適格です。しかし人員が足らないからといって、客室清掃やベッドメイキング、レストランの配膳などを業務の一部として行うのであれば認められないということになります。飲食業では店舗マネジメントを行う場合でも、実態が通常のホール接客や調理、仕込みばかりであれば単純労働とみなされます。管理業務については、1店舗のみの場合は、技人国の該当性があるとは言えません。一般的に求人の際の採用基準に、未経験であってもすぐに慣れますと記載されていて、業務内容や学歴不問という場合は、技人国の業務の対象にはなりません。

入社後の実務研修がどこまで許されるかについては、活動全体を捉えて判断がされます。日本人についても入社当初は同様の研修に従事する場合は、一時的な現場業務が許容されます。ただしこれには詳細なキャリアプランと研修計画書の提出が必要となりますし、期限の定めのない現場配置は許可の対象になります。そしてその研修が終われば、必ず技人国に該当する職務内容に就かせることが必要です。

次に、上陸許可基準適合性について説明します。上陸許可基準適合性とは申請者自身に求められる要件になります。知識に関連する科目を専攻して大学を卒業し、または同等以上の教育を受けたこと、または当該技術、もしくは知識に関連する科目を専攻して日本の専修学校の専門課程を終了し、専門士の称号を取得したことのいずれかの要件が学歴要件になります。大学卒業は短大卒業でも大丈夫です。大学の場合では日本の大学でも海外の大学でも要件を満たしますが、専門学校卒業の場合は海外の専門学校は含まれないです。学歴がない場合、職歴要件が要件を満たせば大丈夫です。職歴要件は10年以上の実務経験を有することが必要で、国際業務の場合は、3年以上の関連業務の実務経験になります。内容の関連性については、大卒の場合と専門学校卒の場合で判断が別れます。大卒の場合は、専攻科目と業務の関連性は柔軟に判断されます。しかし、専門学校卒業の場合は、関連性の判断は原則として極めて厳格な関連性が必要です。

給料について上陸許可基準は、日本人が従事する場合に受け取る報酬と同等以上の報酬を受けることが定められています。

最後に相当性についてですが、法務大臣が適当と認めるに足りる相当の理由があるときに限り許可できるとされています。例えばいくら優秀な大学を卒業していても資格外活動違反、いわゆるオーバーワークがあった場合は、在留不良と言って資格変更が不許可になったりします。留学生の場合は週28時間までしかアルバイトはできないですが、中には週40時間働いてしまっているという外国人もいます。これはオーバーワークになりますので、いくら良い大学で単位を全部取得していたとしても、オーバーワークを理由に技人国への在留資格変更が不許可になりますので注意が必要です。また最近厳しくなっているのは法的義務の履行についてです。よくあるのは住居地の届出や、転職や退職をした際の所属機関に関する届出について、期日までに届け出を出さなければなりません。これを持って在留資格の変更とか更新が許可になるケースは現状はないです。しかし注意していただきたいのは、永住申請が不許可になっています。

ここまで在留資格該当制、上陸許可基準適合性、相当性について満たしていることが技人国を取るために必要と説明してきました。もう一つ付随要件としてお伝えします。それは入管が持っている情報との矛盾についてです。入管は、その外国人本人が過去に来日したときに申告した内容、提出した内容、すべてをデータ情報として保管しています。過去に観光で来日したときに、会社経営者と書いておきながら、就労ビザを申請するときには経営者ではなく、技術者として直近10年働いたというケースなどは、過去の内容と違うということで、申請内容全体の信憑性が疑われることになります。

Stricter Screening for the “Technical/Humanities/International Services” Status

Starting in 2026, the Immigration Bureau has tightened its screening process for the “Technical/Humanities/International Services” status. The three conditions for this status are as follows:

First, eligibility for the status of residence; second, compliance with the criteria for landing permission; and third, appropriateness.

Eligibility for the status of residence refers to whether the activities the foreign national intends to engage in fall within the definition of the “Technical, Humanitarian, and International Services” status of residence. The relevant provisions state that such activities must be conducted based on a contract with a public or private organization in Japan. This contract refers to an employment contract, a contract for services, or similar agreements. The nature of the work will be explained separately under the categories of “Technical,” “Humanities and Knowledge,” and “International Services.” “Technical” refers to work requiring specialized knowledge and skills in the so-called “science and engineering” fields, such as natural sciences, engineering, agriculture, medicine, and pharmacy. Major job categories include system engineers, programmers, mechanical designers, scientific researchers, and architectural designers. “Humanities and International Affairs” refers to work requiring knowledge in the “humanities and social sciences” fields, such as law, economics, sociology, literature, and languages. Major job categories include corporate planning, marketing, trade administration, legal affairs, compliance, accounting, and finance. A current point of contention involves cases where foreign nationals work at reception desks in mobile phone shops. The question is whether the sole task of selling mobile phones qualifies under the “Skilled Professional” category. The argument is that even someone with no prior experience could likely sell mobile phones after gaining one or two years of experience. I believe this is where the line is drawn. “International Business” refers to translation, interpretation, language instruction, public relations, advertising, or overseas trade operations, as well as design related to fashion and interior decoration, product development, and other similar tasks.

Regarding the boundary for unskilled labor, generally speaking, repetitive, routine tasks that can be performed with minimal training and without specialized knowledge are considered unskilled labor. Even if a position is labeled as “production management” or “quality control” on a manufacturing floor, if the actual duties involve assembly line work, machine operation, and visual inspection, it does not qualify and will be denied. So-called on-site foreman or team leader roles are classified under Specific Skilled Worker Type 2. Supervising on-site operations under the Skilled Laborer (Technical/Human Resources/International) visa carries the risk of being charged with aiding and abetting illegal employment. In the hotel and travel industries, duties such as interpreting and guiding, or planning and translating websites for overseas audiences, are eligible. However, if staff shortages lead to performing tasks such as room cleaning, bed-making, or restaurant serving as part of the job, this will not be approved. In the food and beverage industry, even if the position involves store management, if the actual duties consist primarily of standard front-of-house service, cooking, or food preparation, the work is considered unskilled labor. Regarding management duties, if the role applies to only a single store, it does not qualify under the Skilled Laborer (Technical/Human Resources/International) visa category. Generally, if job postings state that candidates can “adapt quickly even without experience” and do not specify job duties or educational requirements, the position does not qualify for the Skilled Laborer (Technical/Human Resources/International) visa.

The extent to which on-the-job training is permitted after joining the company is determined by evaluating the overall scope of activities. Even for Japanese nationals, temporary assignment to on-site duties is permitted if they are engaged in similar training during the initial period after joining the company. However, this requires the submission of a detailed career plan and training plan, and only assignments with no set time limit are eligible for approval. Furthermore, once the training is complete, the individual must be assigned to a position that falls under the scope of the Technical, Professional, and Management (TPM) visa.

Next, I will explain the criteria for eligibility for landing permission. Eligibility for landing permission refers to the requirements that must be met by the applicant. The educational requirements include either graduating from a university with a major in a subject related to the relevant knowledge, or having received an equivalent or higher level of education; or completing a specialized course at a Japanese vocational school with a major in a subject related to the relevant technology or knowledge and obtaining the title of “Specialist.” A junior college degree is also acceptable. In the case of a university, both Japanese and overseas universities satisfy the requirements; however, for vocational school graduates, overseas vocational schools are not included. If you do not have a university degree, you are eligible as long as you meet the work experience requirements. The work experience requirement mandates at least 10 years of practical experience; for international business roles, at least 3 years of relevant practical experience is required. The assessment of relevance differs between university graduates and vocational school graduates. For university graduates, the relevance between their major and the job duties is evaluated flexibly. However, for vocational school graduates, the assessment of relevance is, in principle, extremely strict.

Regarding salary, the criteria for landing permission stipulate that the remuneration received must be equal to or higher than what a Japanese national would receive for the same work.

Finally, regarding appropriateness, permission is granted only when there are sufficient grounds for the Minister of Justice to deem it appropriate. For example, even if you graduated from a prestigious university, if you have violated regulations on activities outside your status of residence—commonly known as “overworking”—you may be deemed to have engaged in improper conduct, resulting in your application for a change of status being denied. International students are limited to part-time work of up to 28 hours per week, but some foreign nationals end up working 40 hours per week. This constitutes overwork, so even if you have earned all your credits at a prestigious university, your application to change your status of residence to “Engineer, Specialist, or International Expert” may be denied on the grounds of overwork, so caution is required. Additionally, compliance with legal obligations has recently become stricter. Common examples include failing to submit notifications regarding your place of residence or changes in employer upon changing jobs or resigning by the deadline. Currently, there are no cases where such omissions result in approval for a change or renewal of status of residence. However, please be aware that permanent residency applications are being denied.

So far, I have explained that meeting the requirements for the relevant status of residence, compliance with landing permission criteria, and appropriateness are necessary to obtain the “Engineer, Specialist, or International Expert” status. I would like to mention one additional requirement: inconsistencies with information held by the Immigration Bureau. The Immigration Bureau stores all information—including declarations and documents submitted by the foreign national during past visits to Japan—as data. For example, if you stated that you were a company executive when you previously visited Japan as a tourist, but then claim on your work visa application that you have worked as a technician for the past 10 years rather than as an executive, this discrepancy with your past statements will cast doubt on the credibility of your entire application.

“技术、劳务及管理”在留资格的审查趋于严格

 自2026年起,入国管理局将对“技术、劳务及管理”在留资格的审查进行严格化。该在留资格的三个条件如下:

第一是在留资格的适用性,第二是符合登陆许可标准,第三是合理性。

所谓在留资格适用性,是指该外国人拟从事的活动是否符合“技术、人文知识、国际业务”这一在留资格的定义。条文中规定,该活动须基于与日本国内公私机构的合同进行。此处所指的合同包括雇佣合同、业务委托合同等。关于业务内容,将按技术、人文知识、国际业务三类分别说明。“技术”是指需要理学、工学、农学、医学、药学等所谓理科专业知识和技术的业务。主要职业包括系统工程师、程序员、机械设计师、科研人员、建筑设计师等。所谓“人文知识”,是指需要法律、经济、社会、文学、语言等文科知识的业务。主要行业包括经营企划、市场营销、贸易事务、法务、合规、会计、财务等。目前引发争议的是在手机卖场等场所由外国人担任接待员的情况。问题在于仅销售手机的业务是否属于“技术、人文、国际业务”范畴。即便是毫无经验者,积累一两年经验后应该也能胜任手机销售工作。我认为这便是界限所在。所谓“国际业务”,是指翻译、口译、语言教学、公关、宣传或海外交易业务,以及与服装、室内装饰相关的设计、商品开发及其他类似业务。

关于简单劳动的界定,一般而言,属于重复定型作业,即使没有专业知识,经过一定培训也能胜任的业务即为简单劳动。即使在制造现场以生产管理、质量管理为名,但实际上兼任生产线组装、机械操作、目视检查等工作,则不符合条件,将不予许可。所谓的现场组长或现场领导工作,被视为特定技能2号的职责。若在“特定技能2号”持有人担任现场监督,将面临被指控“助长非法就业罪”的风险。在酒店及旅游业中,导游服务或面向海外网站的翻译策划业务符合资格要求。但若因人手不足而将客房清洁、铺床、餐厅上菜等作为业务的一部分,则不予认可。在餐饮业,即使从事店铺管理,若实际工作内容仅限于常规的大堂接待、烹饪或备料,则会被视为简单劳动。关于管理业务,若仅管理一家店铺,则不能认定符合“技人国”的适用条件。一般而言,若招聘启事中注明“即使无经验也能很快上手”,且不限工作内容或学历,则不属于“技人国”的业务范畴。

关于入职后的实务培训在何种程度上被允许,将根据整体活动情况进行判断。对于日本人,若入职初期也参与类似的培训,则允许暂时从事现场业务。但此举需提交详细的职业规划和培训计划书,且无期限的现场配置属于许可范围。此外,培训结束后,必须安排其从事符合“技术、专业及管理人才”类别的职务。

接下来,说明关于登陆许可标准符合性的问题。登陆许可标准符合性是指对申请人本人提出的条件。学历要求包括:在大学主修与该知识相关的科目并毕业,或接受过同等及以上教育;或者在日本专修学校的专业课程中主修该技术或知识相关的科目并完成学业,取得“专业士”称号。大学毕业包括短期大学毕业。若为大学学历,无论日本或海外大学均可满足要求;但若为专门学校毕业,则不包括海外专门学校。若无学历,只要满足工作经历要求即可。工作经历要求需具备10年以上的实际工作经验;若从事国际业务,则需具备3年以上的相关业务实际工作经验。关于内容的相关性,大学毕业生与专科学校毕业生的判断标准有所不同。对于大学毕业生,专业科目与业务的相关性将采取灵活判断;但对于专科学校毕业生,原则上需具备极其严格的相关性。

关于薪资,登陆许可标准规定,必须获得与日本人从事该工作时所获报酬相当或更高的报酬。

最后关于相当性,规定仅当存在法务大臣认为足以认可的相当理由时,方可予以许可。例如,即使毕业于再优秀的大学,若存在违反资格外活动规定(即超时工作)的情况,会被视为在留不良,导致资格变更申请被驳回。虽然留学生每周最多只能打工28小时,但其中也有外国人每周工作40小时的情况。这属于超时工作,因此即使是在名校修满所有学分,也会因超时工作为由被拒绝变更居留资格为“技术、劳务、国际业务”类,需特别注意。此外,近期对履行法律义务的要求也日益严格。常见的情况包括居住地申报,以及在换工作或离职时关于所属机构的申报,这些都必须在规定期限内提交。目前尚无因未履行这些义务而被批准变更或更新在留资格的案例。但需要特别注意的是,这可能导致永住申请被驳回。

到目前为止,我们已说明了满足在留资格对应制、登陆许可标准符合性及相当性是获得“技术/专业人员/国际人员”在留资格的必要条件。现在再介绍一项附带要件,即与入管局掌握的信息是否存在矛盾。入管局会将该外国人过去来日时申报的内容及提交的材料全部作为数据信息予以保存。例如,过去以旅游身份来日时自称是公司经营者,但在申请工作签证时却声称最近10年并非作为经营者而是作为技术人员工作,这种与过去内容不符的情况,将导致申请内容整体的可信度受到质疑。
