『経営・管理ビザ』“厳格化” ネパール人経営者が支えるインドカレー店に存続危機 ビザ取得要件「資本金500万円→3000万円」

本格カレーとナンで人気のインド・ネパール料理店が存続の危機に陥っている。

その背景は、高市政権のもとで進められている「外国人政策」の見直しだ。

「経営・管理ビザ」の要件のひとつの資本金が500万円から3000万円まで大幅に引き上げられ、これらの条件を再来年の10月までにクリアする必要があるのだ。

移民に詳しい専門家によると、インド・ネパール料理店は現在、国内におよそ5000店舗あるとされ、その数はハンバーガーチェーン・マクドナルドよりも多いのだそう。

実は、近年増えたこのようなカレー店の経営者のほとんどはインドではなく、お隣り、ネパールの人たち。お店ではネパールカレーでなく、インドカレーと言って提供する。インドカレーの方が日本人にとって馴染み深いためである。

11年前はおよそ5万4000人だった日本に在留するネパール国籍の人の数は去年6月末時点で27万3000人と10年でおよそ5倍に。おととし、在留外国人トップ5にランクインしている。

その理由は、技能ビザという在留資格で来日し、現地で働いてるレストランから10年以上の在職証明書をもらえば日本に来れるので、来日しやすいという背景がある。

さらに最近では、技能ビザでコックとして働きながら店の運営を学び、その後、日本で会社を経営するための在留資格である「経営・管理ビザ」を取得して独立するケースも増えてきた。

ところが、「経営・管理ビザ」を取得するための要件が厳格化された。

経営・管理ビザは、これまで「500万円以上の資本金」もしくは「2人以上の常勤職員」などの条件を満たした会社を作れば比較的簡単に取得ができていた。

しかし、「移住目的でペーパーカンパニーが設立されビザが悪用されている」といった世論を受けて、去年10月に要件が変更されたのだ。

日本人・永住者などの常勤スタッフや、一定の日本語能力が必須になったほか、500万円の資本金はなんと3000万円まで大幅に引き上げられたのだ。これらの条件を再来年の10月までにクリアしないといけない。

この厳格化は、悪用して経営実態もないのに『空っぽの会社』を作って、日本へ移住してしまうというようなケースが多発しているということが背景にある。

真面目に一生懸命働き、納税、社会保険納付などの義務を果たし、日本社会と共生している外国人に対して、緩和措置が検討されるのか、状況を注視したいと思う。

“Management Visa” Tightened: Nepalese-Run Indian Curry Restaurant Faces Survival Crisis as Visa Requirements Shift from ¥5 Million to ¥30 Million Capital

An Indian-Nepalese restaurant popular for its authentic curry and naan faces a survival crisis.

This stems from the review of “foreign policy” under the Takaichi administration.

One requirement for the “Management Visa” has been drastically raised from 5 million yen to 30 million yen in capital, and these conditions must be met by October of the year after next.

According to immigration experts, there are currently around 5,000 Indian and Nepalese restaurants in Japan—more than the number of McDonald's hamburger chains.

In fact, most owners of these curry restaurants, which have proliferated in recent years, are not Indian but from neighboring Nepal. They serve what they call “Indian curry” rather than Nepalese curry, as Indian curry is more familiar to Japanese customers.

The number of Nepalese nationals residing in Japan, which was around 54,000 eleven years ago, reached 273,000 by the end of June last year—a roughly fivefold increase over ten years. The year before last, Nepal ranked among the top five countries of origin for foreign residents.

The reason lies in the ease of entry: Nepalese can come to Japan under the Technical Intern Training visa status. If they obtain a certificate of employment for over ten years from a restaurant where they work locally, they can come to Japan.

Recently, there has also been an increase in cases where individuals work as chefs on a Technical Intern Training visa while learning restaurant management, then obtain a “Management and Administration Visa”—a status allowing them to run a company in Japan—to start their own business.

However, the requirements for obtaining a Management and Administration Visa have been tightened.

Previously, this visa could be obtained relatively easily by establishing a company meeting conditions such as having “capital of 5 million yen or more” or “two or more full-time employees.”

However, in response to public opinion citing “paper companies being established for immigration purposes and the visa being abused,” the requirements were changed last October.

Full-time staff who are Japanese nationals or permanent residents, along with a certain level of Japanese language ability, are now mandatory. Furthermore, the required capital has been drastically raised from 5 million yen to a staggering 30 million yen. These conditions must be met by October of the year after next.

This tightening stems from the frequent occurrence of cases where individuals abuse the system by creating ‘empty companies’ with no actual business operations to facilitate immigration to Japan.

We will closely monitor whether leniency measures will be considered for foreign nationals who work diligently, fulfill their obligations such as paying taxes and social insurance, and coexist within Japanese society.

其背景在于:持技能签证来日者若能获得当地餐厅出具的十年以上在职证明,即可赴日工作,入境门槛相对宽松。

近年来更出现新趋势:持技能签证以厨师身份工作期间学习店铺经营管理,随后取得“经营管理签证”(用于在日本经营公司的居留资格)实现独立创业的案例日益增多。

然而,“经营管理签证”的申请条件已趋严苛。

此前该签证仅需满足“注册资本500万日元以上”或“配备2名以上全职员工”等条件即可相对容易获得。

但去年10月因舆论反映“存在为移民目的设立空壳公司滥用签证的情况”,相关要求被修改。

如今不仅必须配备日本人或永久居民等全职员工及具备一定日语能力,500万日元注册资本更大幅提高至3000万日元。所有企业必须在后年10月前满足这些条件。
